uno de los temas que m\u00e1s nos preocupa es saber si estaremos a la altura y si pasaremos el per\u00edodo de prueba, puesto que en este per\u00edodo se<span style=\"mso-spacerun: yes;\">&nbsp;<\/span>puede dar por finalizada la relaci\u00f3n laboral sin preaviso, sin necesidad de alegar ninguna causa y sin derecho a indemnizaci\u00f3n.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">El per\u00edodo de prueba siempre se debe establecer por escrito. En los contratos de trabajo deben establecer el tiempo de duraci\u00f3n del per\u00edodo de prueba, pero siempre, como establece el art. 14 del Estatuto de los Trabajadores: \u201ccon sujeci\u00f3n a los l\u00edmites de duraci\u00f3n que, en su caso, se establezcan en los convenios colectivos.\u201d<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">El art. 14 del Estatuto de los trabajadores sigue diciendo que \u201cen defecto de convenio la duraci\u00f3n no podr\u00e1 exceder de: Seis meses para los t\u00e9cnicos titulados. Dos meses para el resto de los trabajadores o tres meses en el caso de empresas de menos de 25 trabajadores\u201d<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">Por ello el Estatuto de los Trabajadores es una norma subsidiaria en el tema que nos ocupa, es el convenio quien debe regular el per\u00edodo de prueba, <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>y \u00bfqu\u00e9 pasa en los convenios? en la mayor\u00eda <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>de los convenios se establece unos per\u00edodos de prueba razonables, pero hay casos en los que los per\u00edodos de prueba son excesivamente largos. Pero el <span style=\"color: #800000;\"><a href=\"http:\/\/portaljuridico.lexnova.es\/jurisprudencia\/JURIDICO\/101986\/sentencia-ts-sala-4-de-20-de-julio-de-2011-periodo-de-prueba-cese-de-la-trabajadora-despido-i\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #800000;\">Tribunal Supremo<\/span><\/a><\/span> ha dejado sentado que ser\u00e1n despidos improcedentes las extinciones de contrato por no pasar el per\u00edodo de prueba cuando \u00e9ste sea de \u201cduraci\u00f3n excesivamente dilatada\u201d, aunque est\u00e9 en convenio, cuando sobrepase el tiempo razonablemente necesario para \u201cla comprobaci\u00f3n de la aptitud profesional y la adaptaci\u00f3n al puesto de trabajo del trabajador contratado.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">Es curioso, <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>que a pesar de la doctrina del Tribunal Supremo el gobierno, excepciona el r\u00e9gimen general del per\u00edodo de prueba fijado en el art\u00edculo 14 del Estatuto de los Trabajadores, <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>permitiendo concertar la prueba hasta con un a\u00f1o de duraci\u00f3n para los contratos indefinidos de apoyo a los emprendedores. Claro que as\u00ed ha pasado que <span style=\"color: #800000;\"><a href=\"https:\/\/blogs.imf-formacion.com\/blog\/recursos-humanos\/los-expertos-analizan\/periodo-de-prueba-de-un-ano-despido-libre-y-gratis\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #800000;\">a finales del a\u00f1o pasado<\/span><\/a><\/span><span style=\"color: #800000;\"><a href=\"https:\/\/blogs.imf-formacion.com\/blog\/recursos-humanos\/los-expertos-analizan\/periodo-de-prueba-de-un-ano-despido-libre-y-gratis\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #800000;\">&nbsp;una sentencia del Juzgado de lo Social de Barcelona<\/span><\/a> <\/span>ya ha declarado <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>improcedente el despido de un trabajador, que fue contratado con un contrato indefinido de apoyo a los emprendedores,<span style=\"mso-spacerun: yes;\">&nbsp; <\/span>la empresa le comunic\u00f3 el fin de su contrato despu\u00e9s de un a\u00f1o trabajado, por no superar el periodo de prueba. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">Por ello creo que es muy recomendable que cuando nos encontremos con estos per\u00edodos de prueba tan abusivos y nos despidan debemos acudir a los tribunales para obtener amparo. <\/span><\/p>\n<p class=\"ecxMsoNormal\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">Marta Mart\u00ednez<\/span><\/p>\n<p class=\"ecxMsoNormal\"><strong><span style=\"font-size: 10.0pt; font-family: 'Arial','sans-serif'; color: black; background: white; font-weight: normal;\">\u00bfTe ha gustado este post? \u00bfQuieres recibir antes que nadie todos nuestros art\u00edculos sobre Recursos Humanos?
