sin trabajo y la empresa no te pague los salarios y la indemnizaci\u00f3n, sino que adem\u00e1s el organismo oficial que se encarga de pagar en tales casos se encuentre colapsado, dicho organismo es el <a href=\"https:\/\/blogs.imf-formacion.com\/blog\/recursos-humanos\/los-expertos-analizan\/857\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #800000;\"><strong>Fondo de Garant\u00eda Salarial (FOGASA<\/strong><\/span>)<\/a>.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; line-height: normal;\"><span style=\"font-size: 12.0pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: ES;\">La carga de trabajo del FOGASA, que se encarga de gestionar los expedientes y sufragar las indemnizaciones y los salarios de los trabajadores de empresas que se hayan declarado insolventes o en concurso de acreedores, se ha triplicado en los \u00faltimos a\u00f1os mientras su plantilla se reduc\u00eda.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; line-height: normal;\"><span style=\"font-size: 12.0pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: ES;\">Seg\u00fan fuentes del Ministerio de Trabajo e Inmigraci\u00f3n en 2013 entraron 27.304 casos y solo pudo resolver 7.951 casos. Si antes se resolv\u00edan en tres o cuatro meses ahora se tarda m\u00e1s de un a\u00f1o, y en alg\u00fan caso hasta dos seg\u00fan fuentes sindicales .Legalmente seg\u00fan el <strong><span style=\"color: #800000;\"><a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-1985-6029\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #800000;\">Real Decreto 505\/ 1985<\/span><\/a><\/span><\/strong> referente a la organizaci\u00f3n y funcionamiento del Fondo de Garant\u00eda Salarial el plazo m\u00e1ximo ser\u00e1 de tres meses para dictar resoluci\u00f3n en primera instancia contados a partir de la presentaci\u00f3n de la solicitud.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; line-height: normal;\"><span style=\"font-size: 12.0pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: ES;\">Para que el FOGASA pague es necesario que estudie todo el expediente, que debe incluir la sentencia o la resoluci\u00f3n pertinente. Despu\u00e9s, los letrados son los que deciden la cantidad y la forma de pago. Para realizar todas estas operaciones, por ejemplo en la unidad perif\u00e9rica de Madrid hay 29 personas, que resultan claramente insuficientes para toda la carga de trabajo que acumulan y que no pueden sacar adelante.<\/span><span style=\"font-size: 12.0pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: ES;\">El Ministerio de Trabajo e Inmigraci\u00f3n es consciente de lo que ocurre e intenta paliarlo con la contrataci\u00f3n de personal externo de la empresa p\u00fablica Tragsatec.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"mso-margin-top-alt: auto; mso-margin-bottom-alt: auto; line-height: normal;\"><span style=\"font-size: 12.0pt; font-family: 'Verdana','sans-serif'; mso-fareast-font-family: 'Times New Roman'; mso-bidi-font-family: 'Times New Roman'; mso-fareast-language: ES;\">UGT ha visto con recelo este proceso, ya que la formaci\u00f3n de estos operarios ha sido de un cursillo de dos o tres semanas. No creen que est\u00e9n suficientemente preparados para afrontar la resoluci\u00f3n de los expedientes y que sean los correspondientes letrados los que den el visto bueno definitivo a cada caso. En su opini\u00f3n, hay mucha tramitaci\u00f3n y muchas circunstancias que no se pueden aprender en un periodo formativo tan corto. No obstante, Empleo conf\u00eda en que el n\u00famero de quiebras de empresas se frene este a\u00f1o, lo que har\u00eda que entraran menos casos.
