yes;\">&nbsp;<\/span>en la actualidad resulta frecuente que alg\u00fan familiar o amigo te comente que siempre el empresario se retrasa varios d\u00edas e incluso meses en pagarle su sueldo, pero \u00bfQu\u00e9 puede hacer un trabajador que de forma continuada y persistente sufre el retraso en el abono del salario?<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">Los trabajadores normalmente esperan pacientemente a que la situaci\u00f3n se normalice para evitar poner en riesgo su puesto de trabajo. Sin embargo, si los retrasos en los pagos son amplios o continuados, pueden optar por buscar protecci\u00f3n legal. Las posibilidades legales son:<\/span><\/p>\n<ul>\n<li><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">Denunciar ante la Inspecci\u00f3n de Trabajo la situaci\u00f3n de retraso. A la empresa se le impondr\u00eda una sanci\u00f3n cualificada como \u00abmuy grave\u00bb y que implica una multa de entre 6.251 y 187.515 euros.<\/span><\/li>\n<\/ul>\n<ul>\n<li><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">Previo intento de conciliaci\u00f3n, reclamar <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>a la Jurisdicci\u00f3n de lo social presentando la correspondiente reclamaci\u00f3n de cantidades dentro del plazo de un a\u00f1o desde que debi\u00f3 percibirse el salario, con un recargo por mora del 10%.<\/span><\/li>\n<\/ul>\n<ul>\n<li><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; font-family: Symbol; mso-fareast-font-family: Symbol; mso-bidi-font-family: Symbol; mso-ansi-language: ES-TRAD;\"><span style=\"mso-list: Ignore;\"><span style=\"font: 7.0pt 'Times New Roman';\">&nbsp;<\/span><\/span><\/span><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">Solicitar la rescisi\u00f3n del contrato de trabajo, con derecho a una indemnizaci\u00f3n legal igual a la establecida para el despido declarado improcedente. El art\u00edculo 50.1 b) del Estatuto de los Trabajadores establece que la falta de pago o los retrasos continuados en el abono del salario pactado son causa justa para que el trabajador pueda solicitar la extinci\u00f3n del contrato. <\/span><\/li>\n<\/ul>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">Esta \u00faltima opci\u00f3n es sin duda la m\u00e1s dr\u00e1stica pero en muchas ocasiones el trabajador no tiene otra soluci\u00f3n, puesto que le facilita una extinci\u00f3n indemnizada y la posibilidad de cobrar la prestaci\u00f3n por desempleo. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">La <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>doctrina del Tribunal Supremo, ha establecido que la dif\u00edcil situaci\u00f3n econ\u00f3mica de una empresa no justifica los retrasos continuados en el abono de los salarios, en una <a href=\"http:\/\/www.poderjudicial.es\/search\/doAction?action=contentpdf&amp;databasematch=TS&amp;reference=6977937&amp;links=%222071\/2012%22&amp;optimize=20140303&amp;publicinterface=true\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"color: #800000;\"><strong>sentencia<\/strong><\/span><\/a> que da la raz\u00f3n a un trabajador, al que reconoce su derecho a que se declare extinguida su relaci\u00f3n laboral y a que se le abonen 94.789 euros.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">La demanda era de un trabajador de un hotel de M\u00e1laga que con 31 a\u00f1os en la plantilla y tras sufrir un despido improcedente y vuelto a readmitir, comenz\u00f3 a cobrar sus n\u00f3minas con retraso de m\u00e1s de un mes.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">La sentencia, que unifica doctrina, concluye que \u00abexisten unos retrasos en el pago de los salarios del trabajador demandante que tienen gravedad suficiente para constituir la causa de extinci\u00f3n\u00bb, puesto que dichos retrasos son \u00abcontinuados, persistentes en el tiempo y cuantitativamente importantes. <\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">El alto tribunal califica de grave el incumplimiento y declara la extinci\u00f3n del contrato con independencia de la situaci\u00f3n econ\u00f3mica de la empresa. \u00abEs indiferente dentro del art\u00edculo 50 del Estatuto de los Trabajadores que el impago o el retraso continuado del salario venga determinado por la mala situaci\u00f3n econ\u00f3mica empresarial\u00bb.<\/span><\/p>\n<p class=\"MsoNormal\" style=\"text-align: justify;\"><span lang=\"ES-TRAD\" style=\"font-size: 12.0pt; line-height: 115%; mso-ansi-language: ES-TRAD;\">Pero es necesario advertir que no todo incumplimiento empresarial en el pago puntual del salario <span style=\"mso-spacerun: yes;\">&nbsp;<\/span>justifica la medida extintiva, sino \u00fanicamente aquel que tenga la gravedad suficiente.<\/span><\/p>\n<p class=\"MsoNormal\"
